1. Agreement
By using koubit.me, you agree to these terms. If you do not agree with them, please do not use the site. These terms govern the website only. They do not govern any consulting engagement, which is covered by a separate written agreement.
2. What this site is, and what it is not
This site describes the services Koubit offers and the way Koubit approaches business technology work. Its content is general information published for a general audience. It is not professional, legal, financial, tax, or technical advice about your specific situation, and it should not be relied on as a substitute for advice from a qualified professional who knows your circumstances.
Nothing on this site creates a consultant–client relationship. That relationship begins only when Koubit and a client sign a written agreement describing the work, and not before.
3. Scheduling a conversation
Booking a conversation through this site is an invitation to talk. It does not create an engagement, a fee obligation, or a commitment by either side to proceed. Either party may decline to move forward for any reason.
4. Koubit's intellectual property
The text, layout, design, photography, illustrations, wordmark, and icons on this site are owned by Koubit or used with permission, and are protected by copyright and trademark law. "Koubit" and the Koubit wordmark and compact icon are trademarks of Koubit.
You are welcome to view, share links to, and quote briefly from this site with attribution. Without prior written permission you may not republish substantial portions of it, reproduce it commercially, present it as your own, use the Koubit marks in a way that suggests affiliation or endorsement, or scrape or harvest its contents in bulk — including for the purpose of training machine learning models.
5. Other companies' names and marks
This site refers to other organizations by name in describing Gregory Kouba's prior professional experience. Those names and marks are the property of their respective owners and are used only to describe that experience accurately. Their appearance on this site does not imply endorsement, sponsorship, partnership, affiliation, or a current client relationship, and should not be read as any of those things. No claim of ownership in any third-party mark is made or intended.
6. Third-party services and links
Scheduling on this site is provided by Calendly, and the site links to LinkedIn and other external destinations. Those services are operated by others, not by Koubit. Their own terms and privacy policies govern your use of them, and Koubit is not responsible for their content, availability, or practices. See the Privacy Policy for what those connections involve.
7. Acceptable use
- Do not use this site for any unlawful purpose.
- Do not attempt to gain unauthorized access to the site, its hosting, or any connected system.
- Do not interfere with the site's operation or place an unreasonable load on it through automated requests.
- Do not misrepresent your identity or your affiliation with Koubit.
8. Availability and changes
This site is provided as a convenience. Koubit may change, suspend, or discontinue any part of it at any time, and does not guarantee that it will be available without interruption or that its content is current, complete, or free of error.
9. Disclaimer of warranties
To the fullest extent permitted by law, this site and its contents are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, Koubit and Gregory Kouba will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of this site — whether based in contract, tort, or any other theory, and whether or not Koubit was advised of the possibility of such damages. Where liability cannot be excluded, it is limited to one hundred United States dollars (US$100). Nothing in these terms limits liability that cannot lawfully be limited.
This section concerns the website. Liability arising from a consulting engagement is addressed in the agreement for that engagement.
11. Governing law
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. Any dispute arising from these terms or from use of this site will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
12. Changes to these terms
These terms may be updated from time to time. The effective date above will change when they are. Continuing to use the site after an update means you accept the revised terms.
